Terms of Service

Please read this Terms of Service ("Agreement") carefully before downloading, installing, or using the Systematico mobile application ("Application").

By downloading, installing, or using the Application, you agree to be bound by this Agreement. If you do not agree to these terms, do not download, install, or use the Application.

1. License Grant

Subject to your compliance with this Agreement, the developer of Systematico grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to download, install, and use the Application for your own lawful use. This license does not transfer ownership of the Application or any intellectual property rights.

2. Restrictions on Use

You agree that you will not, and will not permit others to:

• Sell, rent, lease, sublicense, distribute, assign, or commercially exploit the Application.
• Copy, modify, adapt, translate, or create derivative works based on the Application.
• Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Application, except where such restrictions are prohibited by applicable law.
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in the Application.
• Use the Application for any unlawful purpose or in any manner that could interfere with its operation.

3. Intellectual Property

The Application, including its source code, design, user interface, graphics, logos, trademarks, text, and other content, is owned by the developer of Systematico and is protected by applicable copyright, trademark, and other intellectual property laws. Except for the limited license granted in this Agreement, no ownership or intellectual property rights are transferred to you.

4. User Data and Security

Systematico is designed as a local-first application.

Local Storage
All tasks, schedules, journals, settings, and other user data are stored locally on your device. The developer does not collect, store, or process this information on external servers.

Your Responsibility
You are solely responsible for:

• protecting access to your device;
• maintaining backups of your data;
• securing your local network.

Local Synchronization
If you choose to synchronize data between devices over your local network, Systematico encrypts data during transmission. However, no method of electronic transmission can be guaranteed to be completely secure. By using local synchronization, you acknowledge and accept the inherent security risks associated with local network communications.

5. Termination

This Agreement remains effective until terminated. It will automatically terminate if you fail to comply with any provision of this Agreement. Upon termination, you must stop using the Application and delete all copies of it from your devices.

6. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND.

To the fullest extent permitted by applicable law, the developer expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to:

• merchantability;
• fitness for a particular purpose;
• non-infringement;
• title;
• accuracy;
• reliability;
• uninterrupted availability.

The developer does not warrant that the Application will:

• meet your requirements;
• be error-free;
• operate without interruption;
• remain compatible with all devices or operating system versions;
• be free from defects or security vulnerabilities.

You use the Application entirely at your own risk.

7. Limitation of Liability

To the fullest extent permitted by applicable law, the developer shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of, or inability to use, the Application. This includes, without limitation:

• loss of data;
• unauthorized access to your information;
• missed appointments or scheduling errors;
• loss of productivity;
• business interruption;
• financial losses;
• loss of profits;
• personal injury;
• property damage;
• any other direct or indirect damages resulting from the use of the Application.

Your sole and exclusive remedy for dissatisfaction with the Application is to discontinue its use and uninstall it. Nothing in this Agreement excludes or limits liability where such exclusion is prohibited by applicable law.

8. Third-Party Services

The Application may interact with services provided by your mobile operating system or device manufacturer, including Android system services and Google Play. Those services are governed by their own terms and privacy policies, for which the developer is not responsible.

9. Privacy Policy

Your use of the Application is also governed by the Privacy Policy, which explains how your information is handled. By using the Application, you acknowledge that you have read the Privacy Policy.

10. Changes to this Agreement

The developer may update this Agreement from time to time. When changes are made, the "Last Updated" date at the top of this Agreement will be revised. Your continued use of the Application after any updated Agreement becomes effective constitutes your acceptance of the revised terms.

11. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of Ukraine, without regard to its conflict of law principles. If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.

12. Force Majeure

The developer shall not be liable for any delay or failure to perform obligations under this Agreement caused by events beyond reasonable control, including but not limited to natural disasters, war, acts of government, labor disputes, failures of telecommunications networks, power outages, or internet service disruptions.
